You are prohibited from posting or transmitting any unlawful, threatening, libelous, defamatory, obscene, indecent, inflammatory, pornographic or profane material or any material that could constitute or encourage acts or omissions that would amount to a criminal offence or attempt to commit a criminal offence or otherwise violate any law. In addition, you are prohibited from posting or transmitting any information which

(a) contains a virus, bug, worm or other harmful item or program.

(b) is protected by patent, copyright, trademark or other proprietary right, unless with the express written

      permission of the owner of such right.

(c) infringes the rights of others or violates their privacy.

 

onlinekhana.com acts as an independent contractor and is only involved in taking an order online for food items from the user; asking the associate/restaurant or shop to deliver the food ordered by the user. By its very nature, onlinekhana.com is no way involved in the preparation of food and is no way liable or answerable for the content of the food or its choice or otherwise which is at the sole discretion of the user. And if at all any claims are raised by the user pertaining to the quantity, quality or otherwise of the food ordered, the user-member understands and accepts that his claim is and will only be raised against the associate/restaurant and not against onlinekhana.com.

 

The user-member understands and expressly agrees that onlinekhana.com cannot be held liable or responsible in any way to the loss, damage, injury whether direct or indirect, incidental or consequential to all that arising out of the relationship between the user-member and the associate/restaurant whose products or preparations are availed by the user.

 

In the event the food received as per order placed by the user is deficient in quantity, quality or not properly packaged in an hygienic manner, then upon immediately bringing it to the notice of onlinekhana.com, onlinekhana.com shall raise the issue with concerned associate/restaurant and ask to improve the quality.onlinekhana.com may at its discretion black list or remove such associate/hotel/food supplier from its list of suppliers if necessary in the interests of its members.

 

 

CHARGES

 

onlinekhana.com reserves the right to charge subscription and/or membership fees from a user, by giving a prior notice, in respect of any service or any other aspect of this site.

 

 

RESPONSIBILITIES

 

If you use this site, you alone are responsible for maintaining the confidentiality of your account information. You understand that you are financially responsible for all uses of this site by you and those using your login information.

 

 

CONFIDENTIALITY

 

Information concerning onlinekhana.com, or any of its subsidiaries, their employees, customers, suppliers, franchisees  or others on whom data is collected, stored, or processed is the property of onlinekhana.com and is confidential except for the necessary disclosures required by law.

PAYMENTS MADE

 

All online payments that happen for any of the products booked via onlinekhana.com site are secure. onlinekhana.com does not store the Credit card details of any customer in their database or in any data backup system or retrieval systems. Once you are ready to transact you are transferred to the bank site. The card details are captured on the credit card site and not ours hence we cannot be held responsible for any misuse of credit card what so ever.

 

 

CANCELLATION POLICY

 

Online order for delivery, take-away or dining can be cancelled through the internet or through phone by quoting your order-id number, at least 2 hours prior to the time of delivery of the said order. E.g.: If you have placed an online order for delivery or take-away for 8:30 P.M. then this order can be cancelled only before 6:30 P.M. and not after that.

 

 

REFUND POLICY

 

In case of a cancellation of order, the website will refund the charged amount after deducting valid transaction charges of the total amount. The charges will be refunded back to your credit card / debit card / online bank account that was used for the particular transaction.

 

 

GOVERNING LAW

 

All legal disputes will be settled under the laws of Indian courts subject to laws of Republic of India . In the event of any dispute of whatever nature, arising under this Agreement, such dispute shall be settled through good faith negotiation among the parties. In case such dispute can not be resolved by negotiation within 30 days such dispute shall be referred to binding arbitration in accordance with the provisions of the Arbitration and Conciliation Act 1996. The place of arbitration shall be Ghaziabad, India . The decision of the arbitral tribunal shall be final and binding upon the parties. In case of the dispute requiring intervention of courts, courts in Mumbai alone shall have exclusive jurisdiction.

 

onlinekhana.com prompts all its users to register at one time. The details captured during registration are purely to provide better service in future. onlinekhana.com will not be sharing these details with any other third party.

 

 

TERMINATION

 

onlinekhana.com may terminate this User Agreement and these terms and conditions and/or the provision of any of the services at any time for any reason, including any improper use of this site or your failure to comply with these terms and conditions. Such termination shall not affect any right to relief to which onlinekhana.com and its third party providers and distributors may be entitled, at law or in equity.

 

Upon such termination or suspension, your right to use the onlinekhana.com website will immediately cease.
